Privacy Policy

Effective date: April 20, 2026. Club de Crédito ("we", "our", or "us") respects your privacy. This Privacy Policy explains what information we collect, how we use it, and the rights you have over your data.

1. Information we collect

We collect the following categories of information directly from you during enrollment and while we provide our credit repair services:

Identity data: full name, date of birth, last four of Social Security Number (full SSN only when required to file disputes with the credit bureaus or furnishers).
Contact data: mailing address, email address, mobile phone number.
Financial data: credit report data from Experian, Equifax, and TransUnion, including account details, balances, payment history, and dispute results. Billing payment method data (tokenized — we never store full card numbers).
Communication data: messages you send us via SMS, WhatsApp, email, or our client portal; call logs.
Technical data: IP address, device type, and browser information when you submit opt-in or signature forms on our website.
Consent records: the exact text of any SMS/WhatsApp or electronic signature consent you give us, along with timestamp and IP address, kept for audit purposes.

2. How we use your information

To provide credit repair services, including drafting and mailing dispute letters to credit bureaus and furnishers under the Fair Credit Reporting Act (FCRA).
To file complaints on your behalf with the Consumer Financial Protection Bureau (CFPB) when authorized in writing via Power of Attorney.
To send you SMS, WhatsApp, and email notifications about your case — weekly progress updates, document signature reminders, customer support replies, and service notifications.
To process payments for our services.
To comply with the Credit Repair Organizations Act (CROA), FCRA, Fair Debt Collection Practices Act (FDCPA), and applicable state credit services laws.
To maintain an audit log of actions taken on your account for compliance purposes.

3. How we share your information

We share your information only as required to deliver the service you signed up for, and never for third-party marketing.

Credit reporting agencies (Equifax, Experian, TransUnion) and their affiliates — for the purpose of disputing items on your consumer reports on your behalf.
Original creditors and collection agencies (furnishers) — when we dispute information they report about you.
Government agencies (Consumer Financial Protection Bureau, State Attorneys General) — when you authorize us in writing to file a complaint on your behalf.
Service providers that help us operate the service: Lob (certified mail printing), Twilio (SMS/voice infrastructure), Meta WhatsApp Business, Resend (email delivery), Turso (encrypted database hosting), Anthropic (AI letter drafting). Each provider is contractually limited to the specific task we hire them for.
Payment processors (NMI via eCrypt, PaymentCloud) — to process your monthly subscription.

We do not sell, rent, or lease your personal information to any third party. SMS opt-in data and mobile phone numbers are never shared with third parties or affiliates for marketing purposes. Consent records are kept confidential.

4. SMS and WhatsApp messaging

If you opt in to SMS or WhatsApp messaging, we collect your phone number and the text of your consent. You can review the opt-in terms at app.clubdecredito.com/sms-consent. To stop receiving messages at any time, reply STOP to any message you receive. Reply HELP or contact support for assistance. Your mobile phone number is used solely for the messages you consented to and is not shared with any third party or affiliate for marketing.

5. Data security

Sensitive data such as full Social Security Numbers is stored encrypted at rest using AES-256-GCM. Access to client data is restricted to authorized staff. Data transmission occurs over TLS 1.2+. Payment card numbers are tokenized by our PCI-compliant processor and never touch our servers.

6. Data retention

We retain your data for the duration of our service relationship and for up to seven (7) years afterward, as required by CROA record-keeping rules. SMS consent records are retained for at least four (4) years as required by CTIA guidelines. You may request earlier deletion subject to our legal retention obligations.

7. Your rights

Access — you may request a copy of the data we hold about you.
Correction — you may correct inaccurate data.
Deletion — you may request deletion of data not subject to legal retention.
Opt-out — you may withdraw consent for SMS/WhatsApp or email communications at any time.
Portability — you may request your data in a machine-readable format.

8. Children's privacy

Our services are intended for adults 18 years of age or older. We do not knowingly collect data from minors.

9. Changes to this policy

We may update this Privacy Policy from time to time. Material changes will be posted on this page with an updated effective date, and we will notify active clients by email or SMS where required by law.

SMS Communications Privacy

Phone numbers and SMS opt-in data collected through our SMS program will NOT be shared with third parties or affiliates for marketing or promotional purposes. SMS originator opt-in data and consent will not be shared with any third parties for any reason. This applies to all categories of data we collect, including data shared with partners for service-delivery purposes.

Information collected when you opt in to receive SMS messages from Club de Crédito is used solely to deliver the messages you requested (account updates, dispute progress notifications, document signature reminders, customer support replies). You may opt out at any time by replying STOP. Reply HELP for help. Message and data rates may apply.
